This program introduces the core principles that underpin fair and defensible workplace investigations. Participants develop a practical understanding of procedural fairness, allegation structuring, the investigation process, and the responsibilities of investigators in managing workplace complaints.
Advanced Evidence Analysis
This program focuses on developing disciplined evidence assessment skills. Participants learn structured approaches to analysing witness evidence, assessing supporting and contradictory material, identifying evidentiary gaps, and applying the balance of probabilities with appropriate regard to the Briginshaw principle.
Defensibility & Review Certification
This advanced program focuses on the defensibility of investigations and findings. Participants develop the skills required to review investigation processes, assess evidentiary reasoning, and evaluate whether findings are capable of withstanding internal scrutiny, regulatory review, or legal challenge.
Comprehensive Investigation Reviews & Defensibility Assessments
The Procedural Fairness Institute provides independent reviews of completed or ongoing workplace investigations to assess the strength, fairness, and defensibility of the investigation process and findings. This service is designed to provide organisations and investigators with an objective assessment of whether an investigation has been conducted in accordance with procedural fairness principles and sound evidentiary reasoning.
Our review process examines key elements of the investigation, including the structure and clarity of the allegations, the adequacy and relevance of the evidence gathered, the reasoning applied in assessing supporting and contradictory evidence, and whether the findings are appropriately supported on the balance of probabilities.
Particular attention is given to the application of procedural fairness, the quality of evidence analysis, and whether the investigation report clearly demonstrates the reasoning behind the conclusions reached. The review may identify evidentiary gaps, inconsistencies in analysis, or areas where findings may be vulnerable to challenge.
